Stamp Duty :
It is a type of tax which is paid for the transaction performed by way of document or instrument under the provisions of Bombay Stamp Act, 1958 and Indian Stamp Act, 1899.

It is payable on instruments and not on transactions. The definition of the term instrument is very wide.

Instrument means any document by which any right or liability is, or purports to be, created, transferred, limited, extended, extinguished or recorded.

As defined in Evidence Act, document means only matter expressed or described upon substance by means of letters, figures or marks or by more than any of those means intended to be used or which may used for the purpose of recording that matter.

The payment of proper Stamp duty on instruments bestows legality on them. Such instruments get evidentiary value and are admitted in evidence in Court of law. The instruments which are not properly stamped are not admitted in evidence .

Stamp Duty Payment :
The Document which is chargeable with Stamp duty can be prepared on the non-judicial Stamp paper of appropriate value. Unexecuted document can be got franked with special adhesive Stamps by Franking Machine intended for stamping such documents, by tendering required amount in the office of collector of Stamps whereever this facility is available. When documents is lodged for adjudication, on receiving intimation as to the amount of Stamp duty payable by tendering appropriate amount equal to the amount of Stamp duty and penalty if any, the Collector of Stamp shall certify the document as to the payment of proper duty.

Validity of Stamps :
As per the provisions of Section 52-B, the stamps which are purchased and not used within six months shall be rendered invalid thereafter. The stamps purchased and not used for intended purpose are entitled for refund after deduction of certain charges, if lodged for refund within six months from the date of purchase and on fulfilling the conditions stipulated in Chapter V of the Bombay Stamp Act, 1958.The payment of proper Stamp duty on instruments bestows legality on them. Stamp Refund Online Application :
Stamp duty refund application allows a citizen to claim stamp duty refund in cases as – excess stamp duty or penalty paid, cancellation of registered agreement, return of unused stamp paper, cancellation of document where judicial stamp paper is required but non judicial used or vice a versa or stamp duty refund as per court order.

The citizen should submit the documents physically with the concerned office on the same day as submission of online application. Citizens can request for stamp duty refund by using this application from anywhere anytime. The internal process of the department shall be physical with required details and progress being captured online. This will enable citizens to check status about their refund requests online.

2. Copy of E-Challans

“E-Stamp” :
1. True copy of page of computer register.
2. If document is Unregistered-Reports of collector of stamps about locking of E-Stamps.
3. If document is registered-Report of sub-Registrar about locking of E-Stamps.

    Sir, I have paid Court fees of Rs. 32400/- on 14.01.2020 by online mode through the State Bank of India. first time the transaction is unsuccessful therefore, I have done the second transaction but the State Bank of India deducted the payment of Rs. 32400- twice. I have made an Application for Refund of excess court fees. but due to pandamic situation I am unable to take the follow up. so kindly guide me how I can refund my excess court fee.

    I had made On-line payment of requisite court fees stamps worth Rs 20,430/- in respect of first appeal The Orient all Insurance Co ltd -VS- Smt Varsha Khandare and others, which was to be filed with appeal, before Hon’ble High Court, at Nagpur. However, in the said challan, erroneously the name of appellant was typed as “The Oriental Insurance Co Ltd” instead of “The National Insurance Co Ltd”. Due to such mistake, since the online challan became infectious for Appeal to be filed “The National Insurance Co Ltd VS Smt Varsha Khandare & Others. I had again made online payment of Rs 20,430/- for appeal “The National Insurance Co Ltd -VS- Smt Varsha Khandare & Others and annexed the same with appeal filed before Hon’ble High Court, Nagpur.

    I then applied for Refund of Rs 20,430/- erroneously paid in respect of First appeal namely “The Oriental Insurance Co Ltd -VS- Smt Varsha Khandare & Others” to our Nagpur Office of The Collector (Stamps) but Mr Parab of the said office, told me to approach High Court for refund as the amount is paid On-line” in favor High Court. Then I approached the Registrar, High Court, Nagpur with an application dated 01.07.2014, who in turn written a letter dated 17.10.2014 to Shri S.N. Dutonde, of Nagpur office asking to refund the said amount of Rs 20,430/- to me and simultaneously I had been also instructed to approach our Nagpur Office for the purpose.

    I then approach our Nagpur Office for the refund of said amount and our Nagpur office had informed me vide its letter dated 18.10.2014 that next information will be given within 40 days.

    Our Nagpur office then vide its letter dated 18.11.2014 informed me that it has already written to our Pune Office requesting to RE-OPEN the “Refund of E-challan payment” and the amount will be refunded to me after the said
    ‘E-CHALLAN REOPEN” by our Pune office.

    Even dispute such hard efforts by me, till date, no communication or further action is received either from our Nagpur Or from Pune Office and consequently my amount of Rs 20,430/- is being pending for REFUND since 14.06.2014 without any interest. HOWEVER, on display board of our Nagpur Office, “the time of refund of court fees is mentioned “22 DAYS” whereas till then about more than 4 months are being elasped since applying for the same by me.

    Your Hi-erchy, therefore most respectfully requested to look into the matter on TOP PRIORITY and arrange to refund of such huge amount, at least for me, within 15 days and thereby make me obliged for your such favorable action on TOP PRIORITY.

    As per which if any one give his/her land for development for which builder will be providing a flat against it.,for the agreement of this flat whether we have to pay the Non Judicial Stamp paper amount to Revenue Dept of Govt of Maharashtra?
